We have lived in the Houston house for 6 months now and we still have unresolved issues from our closing.
I copied over my March 6th post from my old Myspace blog which is where this issue began.
In summary, no one ever paid our 2006 HOA dues. We only owned the house for 3 days in 2006. We paid the 2007 dues at closing. We didn't find out about the outstanding 2006 dues until we got a statement in March showing that our 2007 account was current. Kevin spoke to the title company and they were supposed to resolve the delinquent 2006 issues.
Well, since I had to send a letter to our HOA regarding another issue recently, I went ahead and added a request to confirm that the 2006 stuff was resolved. Well, it's not!!
Maybe I'm too naive but you would think that... Number 1, the $70 transfer fee we paid to the HOA and the title searches done by the title company should have brought this issue to light BEFORE closing - I mean, they make sure the property taxes are current... Number 2, between all their law degrees, the title company could take care of something they said they would do 3 months ago (not to mention in the first place)... Number 3, the HOA would be sending us letters once a month to let us know "we" still have a balance due... or Number 4, the HOA could keep the account of the previous owner seperate from us so that it wouldn't be our problem at all.
I guess that I'll let Kevin have one last go with the title company - I think we have the senior partner's cell number around here somewhere - and then we'll just pay the dues. I have no idea who is legally responsible. Although, I guess that nothing really happens to you if you don't pay those dues. It didn't keep the VA from selling the house and it didn't keep me from getting our pool tags - what else is there?
